Terms of Use

These terms apply to your use of the website at salisburysymphony.org and the Salisbury Symphony mobile application (together, the “Services”), operated by The Salisbury Symphony, Inc. (“the Symphony”, “we”, “us”). By using the Services, buying a ticket or season pass, or making a donation, you agree to these terms.

Your account

You can browse our website and most of our performances without an account. To buy tickets, manage season passes or view your history in the app, you need an account. We do not use passwords: you sign in with a one-time code sent to your email address or mobile number.

You are responsible for keeping access to that email address or phone number secure, because anyone with access to it can sign in as you. You agree to give us accurate information and to keep it up to date. Please contact us promptly if you believe someone else has gained access to your account.

Tickets and admission

A ticket is a personal licence to attend a specific performance, in a specific seat, at a specific time. It is not a transferable property right. Tickets are valid only for the performance shown and may not be resold or offered for resale for profit without our written consent.

You must be able to present a valid ticket, including the QR code in the app or a printed version, to be admitted. We may refuse admission or remove anyone whose conduct is disruptive, who is in breach of these terms, or who presents a ticket that we reasonably believe is counterfeit, duplicated or obtained fraudulently.

Performances start at the time advertised. Latecomers may be asked to wait until a suitable break in the performance before being seated. Our venues may have their own rules, including restrictions on photography, recording and outside food or drink.

Season passes

Season passes entitle you to redeem tickets to eligible performances within the season and venues covered by the pass you bought. Each pass type includes a set number of events or tickets and is subject to any per-performance limits shown when you buy it. Passes are subject to seat availability and may not be used for performances excluded from the pass.

Redemptions are recorded against your pass. Expired or fully redeemed passes have no remaining value. Where a pass is purchased as a gift, the recipient named at purchase is entitled to use it.

Donations and sponsorships

The Salisbury Symphony is a 501(c)(3) nonprofit organization. Donations support our performances, education programs and operations, and are tax-deductible to the extent allowed by law. We will provide a receipt or acknowledgement as required.

Donations are made voluntarily. Unless a specific fund or campaign is selected, the Symphony may direct a donation to wherever it is needed most. Donations do not purchase tickets, season passes or any other goods or services, and do not entitle you to any benefit beyond those we describe at the time of your gift.

Recurring donations. If you set up a recurring donation, you authorise us to charge the payment method you provide at the interval you choose until you cancel. You can cancel at any time in your account settings under Donate, or by contacting the box office. Cancelling stops future charges; it does not refund charges already made. If you remove your account, any recurring donation or sponsorship pledge on the account is cancelled at that time.

Payments

Payments are processed by Stripe, Inc. We accept card payments and Apple Pay. When you place an order, you authorise us to charge the amount shown, including any applicable sales tax and fees, at the time of purchase.

You may save a payment method for future purchases. Card details are stored securely by Stripe and are never held on our systems. You can remove a saved payment method at any time in your account settings.

Prices, taxes, fees and discounts are shown in United States dollars. Where a discount code applies, the price shown at checkout after applying the code is the price that applies.

Refunds, exchanges and cancelled performances

All ticket and season pass sales are final, except as described in this section. Because our costs are committed to each performance, we cannot offer refunds for a change of mind, for a missed performance, or where a patron chooses not to attend.

Where these options are available for your order, the Services allow you to exchange tickets for another performance or to release seats, as shown when you manage your order. Exchanges are subject to availability and any difference in price.

If the Symphony cancels or materially changes a performance, we will contact ticket holders and provide an appropriate remedy, which may be a refund or a credit that can be used for another performance. Credits issued this way are redeemed through your account and expire as described when they are issued.

Refund requests outside these circumstances are handled by our box office, at our discretion, based on the situation. Please contact us and we will do our best to help.

Acceptable use

When using the Services, you agree not to:

  • obtain, generate or use tickets or season passes you are not entitled to, or attempt to copy, alter or forge a ticket or QR code;
  • interfere with the operation of the Services, or attempt to gain access to any part of them, or to any account, that you are not authorised to access;
  • scrape, harvest or systematically extract content or data from the Services, or use them to send unsolicited communications; or
  • use the Services for any unlawful purpose or in breach of these terms.

We may suspend or close an account, and cancel affected tickets, where we reasonably believe these terms have been broken.

Our content

The Services, and all content in them, including text, photographs, recordings, artwork, our name and logos, are owned by the Symphony or used with permission, and are protected by intellectual property law. You may not copy, reproduce or redistribute that content without our written permission, except that you may share links to our pages and use ticket and confirmation details for your own personal purposes.

Performances may not be photographed, filmed or recorded without our written consent.

Third-party services

Some parts of the Services rely on third parties, including Stripe for payments, Apple Pay for wallet payments, and the app stores that distribute our application. Your use of those services may be subject to their own terms. We are not responsible for the acts or omissions of third parties we do not control.

Availability

We aim to keep the Services available and accurate, but we do not guarantee that they will be uninterrupted or error free. We may change, suspend or withdraw any part of the Services, and may correct errors and inaccuracies, including pricing or availability errors, at any time. If an error affects an order you have placed, we will contact you to confirm or cancel it.

Limitation of liability

To the fullest extent permitted by law, the Symphony is not liable for indirect, incidental, special or consequential losses arising from your use of the Services. Nothing in these terms limits any liability that cannot be limited by law, including your statutory rights as a consumer.

Governing law

These terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute arising from these terms or your use of the Services will be brought in the state or federal courts located in Rowan County, North Carolina, unless applicable law requires otherwise.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the “last updated” date above. Continuing to use the Services after a change means you accept the updated terms.
